New Hampshire Drug Company Sued
A New Hampshire jury recently found a pharmaceutical company guilty in lawsuit over generic drug design. A woman filed a lawsuit claiming that the company manufactured a generic form of a common drug that caused her skin to deteriorate and burn off. She suffered injury to about 60 percent of her body, leaving it in the state of an open wound. Additionally, she became legally blind as a direct result of taking the drug. The company is taking the case to a higher court to decide whether generic drug manufacturers can be sued for design defects that are inherent in the original product. The original suit provided the woman with a $21 million judgment.
The federal court of appeals has thus far upheld the woman’s judgment; however, the drug company wants the matter heard at the Supreme Court. This includes drugs that were improperly manufactured, or drugs made with tainted ingredients.
