New Hampshire Drug Company Sued

A New Hampshire jury recently found a pharmaceutical company guilty in lawsuit over generic drug design. A woman filed a lawsuit claiming that the company manufactured a generic form of a common drug that caused her skin to deteriorate and burn off. She suffered injury to about 60 percent of her body, leaving it in the state of an open wound. Additionally, she became legally blind as a direct result of taking the drug. The company is taking the case to a higher court to decide whether generic drug manufacturers can be sued for design defects that are inherent in the original product. The original suit provided the woman with a $21 million judgment.

The federal court of appeals has thus far upheld the woman’s judgment; however, the drug company wants the matter heard at the Supreme Court. In New Hampshire, as elsewhere, people are protected from defective drugs through state and federal laws. Drug manufacturers are held liable for defective drugs. This includes drugs that were improperly manufactured, or drugs made with tainted ingredients. If you or a family member have been harmed by defective drugs you need to talk to a New Hampshire injury lawyer as soon as possible. The law limits the time you have to file a claim so you must seek help quickly.

If a drug company is negligent in the manufacture of a drug, whether generic or not, they are responsible for injuries that result from taking it. You may be able to get compensation for medical bills, pain and suffering, lost wages, and more. Speak to a New Hampshire injury lawyer as soon as possible. Your lawyer will immediately review the facts of your case and investigate the matter. This will include review of the medical reports.

Injuries due to defective drugs can be very serious. Sometimes, as in the case above, the injuries are severe and long lasting. Other times, the injuries may heal. Still other times, internal injuries may be caused by using the drugs, which can be harmful over time. The drug maker is liable if they are negligent. Your lawyer will often be able to handle several similar complaints together, if they exist. If you have been given an insurance check, talk to your lawyer before cashing it as it could preclude you from proceeding with a lawsuit in the matter.

Most personal injury cases are settled prior to going to court. The settlement is worked out between lawyers for both sides. Many times the drug company settles the claim so that it is not brought to the attention of the media. If the case does go to court, your lawyer will handle the case to get you the money you deserve. Remember that you should not have to pay for any medical expenses or other expenses associated with taking defective drugs. This includes money for lost wages if you had to take time off work. With the help of a New Hampshire injury lawyer you’ll get the money you deserve.
